Agreement between User and WE CHARGE! Bodyboards

Welcome to WE CHARGE! Bodyboards (a registered tradename and division of BayZ Sporting Goods and Apparel, LLC). The WE CHARGE! Bodyboards website, https://chargebodyboards.com (the "Site") is comprised of various web pages operated by BayZ Sporting Goods and Apparel LLC, d/b/a WE CHARGE! Bodyboards, offering information about our products, and offering for sale our products as well as those manufactured by third parties. The Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of the Site constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference. BODYBOARDS AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. WE CHARGE! BODYBOARDS PROVIDES PRODUCTS FOR SALE “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THE WARRANTY OF NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE CHARGE! BODYBOARDS MAKES NO WARRANTY THAT PRODUCES PURCHASED FROM WE CHARGE! BODYBOARDS WILL MEET YOUR REQUIREMENTS ; OR THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE PRODUCTS OR SERVICES WILL BE EFFECTIVE, ACCURATE, OR RELIABLE; OR THAT THE QUALITY OF THE PRODUCTS WILL MEET YOUR NEEDS AND OR EXPECTATIONS.

IN NO EVENT SHALL WE CHARGE! BODYBOARDS OR ITS AFFILIATED COMPANIES, AGENTS, MEMBERS, EMPLOYEES, ATTORNEYS, CONSULTANTS, CONTRACTORS OR OFFICERS (COLLECTIVELY “OUR AFFILIATES”) HAVE ANY OBLIGATIONS OR LIABILITIES TO YOU OR ANY OTHER PERSON FOR LOSS OF PROFITS, FOR LOSS OF BUSINESS, OR FOR INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER THEORY OR FORM OF ACTION, EVEN IF WE CHARGE! BODYBOARDS OR OUR AFFILIATES HAVE BEEN ADVISED OF THE POSSIBILITY THEREOF, ARISING OUT OUR OR IN CONNECTION WITH THE SALE, DELIVERY OR PERFORMANCE OF 3RD PARTY PRODUCTS AND/OR SERVICES RE-SOLD BY WE CHARGE! BODYBOARDS.

WE CHARGE! BODYBOARDS SOLE AND ENTIRE MAXIMUM LIABILITY (AND THE LIABILITY OF OUR AFFILIATES) RELATING TO 3RD PARTY PRODUCTS AND/OR SERVICES RE-SOLD BY WE CHARGE! BODYBOARDS FOR ANY REASON, AND YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE OF ACTION WHATSOEVER, SHALL BE LIMITED TO THE ACTUAL AMOUNT PAID BY YOU FOR THE APPLICABLE 3RD PARTY PRODUCTS AND SERVICES.

SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES. SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU TO THE EXTENT SUCH JURISDICTION’S LAW IS APPLICABLE TO YOUR PURCHASE OF 3RD PARTY PRODUCTS AND SERVICES FROM WE CHARGE! BODYBOARDS.

This Limitation of Liability and Warranty Disclaimer may NOT be altered, supplemented, or amended by the use of any other document(s) unless specific reference is made to the parties’ intent to alter, supplement, or amend a specific provision of this Limitation of Liability and Warranty Disclaimer in writing signed by you and WE CHARGE! BODYBOARDS.

The provisions of this Limitation of Liability and Warranty Disclaimer are separable, severable, and divisible in all respects, and the unenforceability of any specific provision hereof shall not affect the validity of any other provision(s). If a court of competent jurisdiction finds any provision of this Limitation of Liability and Warranty Disclaimer to be unenforceable or invalid under applicable law, then such court shall either reform said provision so that it shall be enforceable under applicable law or construe this Limitation of Liability and Warranty Disclaimer in all respects as if the said provision had been omitted. This Limitation of Liability and Warranty Disclaimer shall be construed and enforced in accordance with the laws of the state of Arizona, without regard to its conflicts of laws provisions.

WE CHARGE! BODYBOARDS MANUFACTURED PRODUCTS

WARNING – RISK OF INJURY OR DROWNING
Use of this bodyboard involves inherent risks, including serious injury or death. Always use under appropriate conditions, wear approved personal flotation devices (PFD) as needed, and never use in unsafe water, strong surf, rip currents, or beyond your abilities. Bodyboards are not designed nor intended to be personal flotation devices (PFD) and should not be used as personal flotation devices (PFD). Children must be supervised by a responsible adult at all times.

BEFORE USING THIS PRODUCT, THE USER MUST DETERMINE THE SUITABILITY OF THE PRODUCT FOR THEIR INTENDED USE AND ASSUMES ALL RISKS AND LIABILITY WHATSOEVER IN CONNECTION THEREWITHIN.

BY USING THIS BODYBOARD, YOU ACCEPT ALL RISKS ASSOCIATED WITH ITS USE. IF YOU DO NOT AGREE, DO NOT USE AND RETURN TO PLACE OF PURCHASE UNUSED.

LIMITED WARRANTY AND DISCLAIMER

WE CHARGE! Bodyboards have a limited warranty against defects in workmanship and/or materials for a period of 60 days from date of purchase, contingent on normal recreational use. This warranty is void if the bodyboard is misused, abused, altered, used commercially, or damaged by impact, puncture, dragging, exposure to excessive heat or sunlight, or normal wear and tear. Please note the following specific exclusions, which are not regarded as defect in workmanship and/or materials and do not fall under warranty terms and are expressly excluded. Creasing the bottom slick skin and/or top deck, damage cause by heat or sun, or improper storage or transport of the board. Damage caused, whether directly or indirectly, by installation and use of a leash or other accessories. Damage cause by excessive force or collision. Damage cause by misuse or abuse. Damage caused by sandsliding; this is not a sand or skim board. Any repairs attempted on the board by any other than the manufacturer will also void this warranty.

Claims must be filed by the original purchaser with the original invoice. The claimant must pay to ship the board back to the manufacturer. The claimant will be reimbursed for the shipping if the claim is approved by the manufacturer. If approved, manufacturer will provide one replacement per bodyboard purchased.

EXCEPT FOR THE LIMITED WARRANTY ABOVE, THIS BODYBOARD IS PROVIDED “AS IS” AND WE CHARGE! BODYBOARDS MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE CHARGE! BODYBOARDS IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, INCLUDING DEATH OR PERSONAL INJURY OR PROPERTY DAMAGE, ARISING FROM USE OR MISUSE OF THIS PRODUCT.

WITHOUT LIMITING THE FOREGOING, WE CHARGE! BODYBOARDS MAKES NO WARRANTY THAT PRODUCES PURCHASED FROM WE CHARGE! BODYBOARDS WILL MEET YOUR REQUIREMENTS; OR THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE PRODUCTS OR SERVICES WILL BE EFFECTIVE, ACCURATE, OR RELIABLE; OR THAT THE QUALITY OF THE PRODUCTS WILL MEET YOUR NEEDS AND OR EXPECTATIONS.

BODYBOARDS OR OUR AFFILIATES HAVE BEEN ADVISED OF THE POSSIBILITY THEREOF, ARISING OUT OUR OR IN CONNECTION WITH THE SALE, DELIVERY OR PERFORMANCE OF PRODUCTS AND/OR SERVICES RE-SOLD BY WE CHARGE! BODYBOARDS.

WE CHARGE! BODYBOARDS SOLE AND ENTIRE MAXIMUM LIABILITY (AND THE LIABILITY OF OUR AFFILIATES) RELATING TO PRODUCTS AND/OR SERVICES RE-SOLD BY WE CHARGE! BODYBOARDS FOR ANY REASON, AND YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE OF ACTION WHATSOEVER, SHALL BE LIMITED TO THE ACTUAL AMOUNT PAID BY YOU FOR THE APPLICABLE PRODUCTS AND SERVICES.
